Aircraft IFR Certification

I am purchasing a airplane and it had a IFR certification performed just one month prior to the pre-buy/annual. During the annual it was noted there was not full aft elevator control due to a large wiring harness interfering. The Pitot tube had to be open and re-routed to correct the problem. Now I am told the Pitot Static test will need to be performed again and the seller is unwilling to pay for this since it is not part of an annual.

I was purchasing this plane to begin my IRF training. Now the question is can IFR training be conducted in a plane under these circumstances?

    The seller is being a jerk.  The aircraft isn’t airworthy without the elevator meeting spec for travel.  Any maintenance to correct that problem is part of the non-inspection cost of the annual.
    When any static line is opened, it must be retested for IFR certification.  If only the electrical harness was moved, there is no need for a static check.

    What else did the seller do or not do to the airplane?
    Do not fall in love with an airplane before you buy it.
    Make absolutely sure you trust the facility doing the pre-buy/annual.
    There is an unfortunate part of this business where $$$$ rules.
    I’d think about walking on this one!
    Think about going to a Flight School that offers a 10-14 day intensive program without buying and airplane.

    The 2 year IFR certification does not include the pitot system. It entails checking the static system for leaks/damage and certifying the altimeter/encoder. Most owners have the 2 year transponder certification done at the same time. Unfortunately over the years the IFR test has come to be known as the “pitot-static” test by many maintenance shops. If only the pitot system was opened it does not void the date of the IFR test. I would, however, inquire into if and how the pitot system was tested after the annual was performed.
