CFI teaching Commercial Certificate

Hello all, have the following question:

Pilot seeking Commercial Certificate is flying the dual cross country with CFI at night required per 61.129. Decide to fly under IFR for safety. Pilot seeking the Commercial certificate is Instrument Rated, current, and acting as PIC. Flight is VMC. Because the flight is conducted under IFR, despite being VMC, can the pilot log it as dual received, or would the CFI need to be CFII because the flight was conducted under IFR? Note the goal is not to log instrument training, just the normal XC dual required. Would that answer change if the flight was in IMC and actual IMC time was also logged?

    The FAA is a little weird about allowing a “One I” to give dual for anything that smacks of instrument training. Example if this is the 2010 Grayson Interpretation – https://www.faa.gov/about/office_org/headquarters_offices/agc/practice_areas/regulations/interpretations/data/interps/2010/Grayson-3_2010_Legal_Interpretation.pdf

    A good argument can be made that so long as there is something in the log entry to indicate that it does not apply to the 10 hours of instrument training for the commercial, it’s OK. But without something definitive from the FAA to guide Examiners, I’d opt to avoid raising the question altogether.
