Commercial Pilot, Instrument Rating

The FAA recognizes 20 hours in an AATD towards IFR rating and 50 hours in an AATD towards Commerical rating. Would a CFI have to be present during those hours in a Sim to count towards the rating? Thank you.

You have to read the regulation.

61.65(i) allows the use of an AATD for 20 hours. 61.65(i)(2) requires an instructor.

61.129(i)(1)(i) is the regulation cited in LOAs for AATDs and it also requires an instructor.
