does a CFI who is acting PIC need to meet 3 TO/L (61.57) to carry only a student pilot?

IOW, does a student pilot (whether he can act as PIC or not) count as a passenger in an instructional flight? Thank you.

    The FAA Chief Counsel issued two letters of interpretation that say no. Neither a trainee nor a CFI are considered to be a passenger on an instructional flight.

    The 2006 Kortokrax (out own Kris) Interpretation applies to certificated pilots http://bit.ly/2alFuGc
