Commercial privileges & 14 CFR 119.23

14 CFR 119.23 clearly says that private carriage operations for compensation or hire require that you operate in accordance with part 135.

Other information (for example, the Ferris letter of interpretation) seems to imply that if a guy owns a plane, a commercial pilot can fly this guy around in his plane for compensation/hire, only providing piloting services.

Would you need a part 135 operating certificate to do this or no?  119.23 seems to indicate yes.

    If you have a commercial certificate and are flying the owner / family around you are legal. If the owner is paying all the costs for the flight… You are legal.

    If the owner is charging his friends to use his airplane with or without your knowledge… You are not legal.

    There are fractional companies who sell fractions of their airplane to make those people owners. At that point the operation is conducted Part 91 subparagraph K.
