Can I shoot this approach???

Hello, i got a question about an approach. Im preparing for my CFII ride and i had to plan a CX for the oral. I choose an approach that i can do, however the missed approach has a climb gradient that i cannot comply with my A/C, can I legally still shoot the approach? i know obviously that I would never do it (and the answer seems obviously no), but im asking from a legal point. If someone could point out anything in the FAR's about this, it would be much appreciated

    FAR 91.175 “(a) Instrument approaches to civil airports. Unless otherwise authorized by the FAA, when it is necessary to use an instrument approach to a civil airport, each person operating an aircraft must use a standard instrument approach procedure prescribed in part 97 of this chapter for that airport. This paragraph does not apply to United States military aircraft.”

    I believe the exception applies for special instrument approaches not published as being available to the general public. The charted procedure contains portions which describe the approach and are regulatory, so if you could not comply with the charted procedure, I think you would be cited for knowingly violating parts 97 and 91.175(a) and throw in 91.13 for careless and reckless.

    That said, often there are higher minimums or a totally different procedure available that meets the standard 200 feet/NM minimum climb gradient. I would not select a procedure that my aircraft was incapable of following in real life or on a CFII practical test.
