CFII retest when student has no CFI rating.

I have a student who does not have a CFI and is going for his CFII.  He failed the flight on his first attempt.  Do I need to endorseme him again to retry?  If so what regulation to I site in the endorsement.

    You also need to endorse under 61.39(a)(6) and fill out another 8710-1 as required in 61.39(a)(7).

    All of the above plus according to AOPA the FAA has ruled one must have a CFI to instruct in an airplane Section 61.195(b), which addresses flight instructor limitations and qualifications with regard to aircraft ratings, directs that a flight instructor may not conduct flight training in any aircraft for which he does not hold “a pilot certificate and flight instructor certifIcate with the applicable category and class rating[.]” The following link is FAA’s response for a legal interpentation of 61.195
