ELT 90 days removed for repair

FAA Regulations

Regs say that I can remove ELT for 90 days for repair. Can I fly beyond 50NM during those 90 days?

    I would interpret the reg to give an answer of yes.

    91.207 (f) states: Paragraph (a) [the part that lays out the requirement of an aircraft having an ELT installed] of this section does not apply to—
    (3) Aircraft while engaged in training operations conducted entirely within a 50-nautical mile radius of the airport from which such local flight operations began; [and]
    (10) An aircraft during any period for which the transmitter has been temporarily removed for inspection, repair, modification, or replacement, subject to the following:
    (i) No person may operate the aircraft unless the aircraft records contain an entry which includes the date of initial removal, the make, model, serial number, and reason for removing the transmitter, and a placard located in view of the pilot to show “ELT not installed.”
    (ii) No person may operate the aircraft more than 90 days after the ELT is initially removed from the aircraft

    {I left out those parts that aren’t pertinent to the question.} A flight beyond 50 NM from the origin airport would disqualify subparagraph (3), not only due to the distance but since it’s not a training flight. However, it doesn’t mention anything about a regular, non-training flight that goes beyond 50 NM. And since it’s been less than 90 days, that would fall under subparagraph (10) which includes no prohibitions against flights farther than 50 NM. So taking all those factors into account, I’d say that a >50 NM flight in an aircraft that has had the ELT removed in less than the previous 90 days and has been fully placarded as required would be perfectly legal within the regs.
