Obstacle Departure procedure compliance

Let us assume that I have filed IFR flight plan from A to B and the departure airport has   ODP in text. At takeoff, tower clears the plane and insturcts to fly runway heading.

In this case, can I still follow the ODP without notifying ATC or put them in the remarks section?

What is the FAA's receommended or rules on this matter?

    It is the pilot option to fly the ODP. However, if ATC is giving you a heading to fly, they are assuming obstacle and terrain clearance responsibility. I would clarify the clearance with ATC prior to accepting it and if you need to fly the ODP, advise the controller.

    This kind of instruction is not normally given unless there is surveillance from the ground or within a very short distance off of the runway. There is new guidance for ATC coming out at the end of this year that will require the controller to only provide headings that are consistent with a published ODP. In the mean time, just make sure you and the controller are on the same page.
