Instrument time from Private PIlot training…

Instrument Rating, part 61 requires - 15 hours of instruction and 40 hours of instrument time.

During the course of my PPL training I had the 3 hours of instrument training. I did this under the hood and with a CFII.

Question - Can I count this time towards my instrument rating in either (instruction or hoodtime) category?

    The time counts for the 40hrs of actual or simulated instrument time. Those three hours from the private pilot course could have been with a CFI or a CFII.

    The reason it does not count toward the 15 hours of instrument training with a CFII is the private pilot hood time is classified as “flight by reference to instruments” and it is different that “instrument training” time… at least from a regulation standpoint

    According to a 2015 legal interpretation by the FAA Office of the Chief Counsel, the 3 hours of training required for PPL DOES in fact count toward the 15 hour IR requirement if it was done with a CFII: https://www.faa.gov/about/office_org/headquarters_offices/agc/practice_areas/regulations/interpretations/data/interps/2016/rohlfing%20-%20(2016)%20legal%20interpretation.pdf
