Question about logging night PIC with a “not valid for night flying or by color signal control” restriction when a CFI is aboard.

Asked by: 5395 views ,
FAA Regulations

My current medical certificate says "Not valid for night flying or by color signal control."  Luckily, this will be removed on my updated medical, but I'm still waiting for it due to a deferrance by my AME due to a medication I was on.

Anyway, I understand that I can still fly at night with my CFI.  That's what I did for the night requirments for my PPL.  I'm doing my IFR training now, which myself and my CFI have been logging as PIC.  Some of these training flights occurred at night.  Can I log those night hours as PIC because my flight instructor was with me, also acting as PIC?  Or is it just total time and dual recieved?

Your restriction does not permit you to “act as PIC” at night. However, to “log PIC”, all that is required is that you are the sole manipulator of the controls. Your CFI has to be the one who “acts as the PIC”.

Agree with John. As long as you are appropriately rated for the category and class of aircraft for that flight, you may LOG PIC time with a CFI on board, even if you are unable to ACT as PIC.

You can log PIC time at night as long as there is somebody onboard who is qualified and current to act as PIC and has agreed to do so. It doesn’t need to be a CFI.
